Under the new rules applications for trademarks and geographical indications for which there is no effective decision until the entry into force of the Trademark and Geographical Indications Act of December 17, 2019 and for applications submitted after that date but before the entry into force of amendments to the Tariff fees collected by the Patent Office, shall be subject to fees in accordance with the amendments introduced by Decree No. 65 of 10.04.2020.
The fundamental change is that now the entire fee is due on the filing of the trademark application. Before the payments were split into two stages.
Prior to deciding on registration on a trademark application or geographical indication covered by such cases, an additional notice for payment shall be sent to the applicant or the person representing him, respectively. The difference between both fees must be paid within 14 days of receiving the notice.
If the fee is not paid, the application is considered withdrawn.
The amendments will enter into force on 14 April 2020.
