This article concerns the Detailed Development Plan- Regulation and Construction plan (DDP-RCP) on land property (agricultural land) for the construction of Photovoltaic power plant (PPP) approved within the procedure for changing the purpose of agricultural land.
The question is whether there is a current DDP-RCP in relation to the land property (agricultural land) in case that the decision of the commission under Art. 17 of the LPAL for change of the purpose of agricultural land expires?
The brief answer is yes.
The arguments are generally related to the fact that since the approved, within the procedure for changing the purpose of agricultural land, DDP-RCP was approved by order and entered into force, it continues to operate, as long as there is no new or amended development plan, which would terminate the effect of the old one. Additional argument is that there is no explicit provision to provide for termination of its action, in case of expiration of the statutory term for the effect of the decision of the commission under Art. 17 of the LPAL for change of the purpose of agricultural land.
