Following the drafting of several bills and number of discussions, Bulgarian National Assembly passed the new Condominium Ownership Management Act. The latter sets forth new forms of management of condominium, adequate penalties to faulty owners, new rules regarding the breeding of pets etc.
The management of condominium in residential complexes shall be regulated by written agreements with a notary approval of the signatures of the investor and the owners. The agreement shall be registered in the Property register so that it is binding to the subsequent owners.
Each building in condominium shall be registered in a public registrar of the municipality and shall have Technical passport and a Book of the owners. The latter shall contain registrations of all owners, habitants, pets bred in the building.
The owners living in condominium may apply for European, national or municipal programs for financing of renovation of buildings by establishing associations of owners. All owners shall participate in the association. The transfer of ownership of a property automatically leads to participation in the association of the successor.
Owners who endanger the building or cause severe damages, or systematically refuse to follow the internal rules, the resolutions of the General meeting or good manners, may be taken out of the building by a resolution of the owners holding 75% of the ideal parts of the building. This measure shall follow a written notification to the faulty habitant. The General meeting could impose a fine to a habitant up to BGN 150, and to legal entities – up to BGN 500.
The monthly fees shall be distributed between all habitants older than 6 years of age. Habitants shall pay an extra fee for each pet which they breed and bring out in the condominium. Habitants, who are absent more than a month, pay a half fee after they notify for their absence.
