The National Assembly adopted the State of Emergency Measures and Actions Act on 23rd of March 2020. The State Gazette promulgated the new Act on the following day. The new provisions entitle the employers and the employees to the following:
1. Organization of the working process under a state of emergency
- The employers will have the right to order his employees to work from home even without their consent. In this case, the employers shall provide the whole equipment and facilities needed.
- The employers will have the right to introduce part-time working hours for his employees during the whole term of the state of emergency or part of it.
- The employers will have the right to terminate the work in their premises or part of them, for all or some of their employees.
- If the work in the employers` premises is terminated due to state authority`s orders, the employers shall not allow their employees to work from their usual place of work.
- The restrictions on working overtime shall not apply for the employees with reduced working hours who help with the provision of medical care.
2. Leaves during the state of emergency
- The employer shall only be allowed to:
- make their employees use their annual paid leave.
- make their employees use up to half of their annual paid leave, including the ones who do not meet the requirements, without their consent.
- The employers have to allow an annual paid leave or an unpaid leave, if any of the following categories of employees asks for such:
- pregnant women,
- minors,
- mothers of disabled children and children under 12,
- lonely fathers,
- disabled employees,
- employees entitled to special protection etc.
3. Remuneration
Employees have the right to receive full remuneration during the company’s suspension of business operаtion.
