State Gazette No 42/2018 announced an amendment of Obligations and Contracts Act regarding partial claims. What was previously a controversial question and an issue related to the applicable court practice is now set forth as a law. Partial claims shall cease or terminate the limitation period only for the part of the receivable subject to the respective partial claim. Prior the amendment this issue was not regulated explicitly and it might be considered as disputable in the legal theory. In addition, there is an amendment of Civil Code Procedure stipulating explicitly the legal opportunity for proceeding simultaneously two court cases for different parts of one receivable. The importance of the matter is determined by the significant quantity of the partial claims and the legal consequences of the court resolutions. The issues related to the limitation period are subject to review under an Interpretation Case of Supreme Cassation Court which is still pending.
