In January 2023, Technotest Jsc engaged our firm to represent them before the Competition Protection Commission (CPC) after Dekra Bulgaria EOOD filed an unfair competition complaint. Technotest responded with a press conference to highlight improper practices by the Executive Agency “Automobile Administration” regarding the recognition of vehicle type approvals from unnamed technical offices.
Our team meticulously prepared a robust defense, articulating strong counterarguments and emphasizing key EU regulations in the transportation sector, including Regulation (EU) No. 168/2013 and Directive 2007/46/EC. We focused on proving that Technotest and Dekra Bulgaria operate in separate markets, reinforcing that they are not direct competitors. A ruling against Technotest could have led to a penalty of up to 10% of their annual turnover, underscoring the high stakes for our client.
The CPC ruled in favor of Technotest, dismissing the unfair competition claims. Although Dekra appealed the decision to the Sofia Administrative Court, we successfully defended our client once again. Finally, the Supreme Administrative Court upheld the previous rulings, securing a significant win for Technotest Jsc.
